Welcome to Party Pilot! These Terms of Service ("Terms") govern your access to and use of our website, tools, and services provided through www.partypilot.co ("Party Pilot," "we," "our," or "us"), a New Jersey-based LLC.
By accessing or using our site or creating an account, you agree to be bound by these Terms. If you do not agree, do not use our services.
1. Eligibility
You must be at least 13 years old to use Party Pilot. By using the site, you affirm that you meet this requirement.
2. Account Registration
To access many features, you must create an account. You agree to provide accurate, complete, and updated information and to keep your login credentials secure. You are responsible for all activity under your account.
We reserve the right to suspend or terminate your account at our sole discretion if we believe you are violating these Terms, engaging in fraudulent activity, or harming other users.
3. Services and Payment
Party Pilot allows users to create and manage events using AI-powered tools, guest trackers, invitation designers, checklists, and more.
Our base fee is $39.99 per event, with optional paid add-ons such as printed invitations or thank-you cards.
All payments are processed through Stripe.
All sales are final. No refunds will be issued.
4. User-Generated Content
You may upload text, images, guest lists, and other content ("User Content"). You retain ownership of your User Content, but grant Party Pilot a non-exclusive, royalty-free license to use, host, store, and display it solely to operate and improve our services.
You are solely responsible for your User Content and warrant that you own it or have the necessary rights to post it. We may remove content that violates these Terms or applicable laws at our sole discretion.
5. Prohibited Uses
You agree not to:
- Violate any law or regulation.
- Upload content that is unlawful, defamatory, or infringes on intellectual property rights.
- Interfere with the security or functionality of the site.
- Use our services to plan or promote illegal or harmful activities.
6. Intellectual Property
All content and materials on Party Pilot, including logos, software, tools, and AI outputs (excluding your User Content), are the property of Party Pilot or its licensors and are protected by copyright, trademark, and other laws.
You may not copy, modify, distribute, or exploit any of our content without written permission.
7. Third-Party Tools
Our site may integrate with third-party tools and services (e.g., Stripe for payments, Lovable.dev hosting). We are not responsible for the availability or reliability of these third parties. Use of their services is subject to their respective terms and privacy policies.
8. Disclaimers
Party Pilot provides tools and suggestions to help plan your event, but:
- We do not guarantee the success of any event.
- AI outputs are for inspiration only and may contain errors.
- We are not liable for lost data, missed invitations, guest responses, or scheduling errors.
- We are not responsible for external links or vendors you choose to work with.
ALL SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.
9. Limitation of Liability
To the maximum extent permitted by law, Party Pilot and its officers, employees, or affiliates will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the site or services.
Our total liability will not exceed the amount paid by you to us in the 6 months prior to the claim.
10. Termination
We reserve the right to suspend or terminate your account and access to services at any time, with or without notice, for any violation of these Terms or for any other reason deemed necessary to protect our platform or users.
11. Changes to Terms
We may update these Terms from time to time. If we do, we'll notify users by updating the "Effective Date" above. Continued use of the site after changes constitutes acceptance.
12. Governing Law
These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles.
